Definitions

Personal data is any information relating to a directly or indirectly identifiable natural person ("personal data").

Subject of  personal data is the visitor to the website (the "subject").

Data controller is PEARS HEALTH CYBER EUROPE, s.r.o., registered office at Voctářova 2449/5, Libeň, 180 00 Prague 8, ID No.: 140 58 987, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 359748 (the "Controller").

Effective legislation relevant in relation to personal data processing means, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR"), Act No. 480/2004 Coll., on Information Society Services, as amended, as well as Act No. 110/2019 Coll., on Personal Data Processing.

The Controller is authorised to process personal data through a processor, that being a company that provides website management and newsletter distribution.

Fulfilling legal obligations

Objective: Where we are required by applicable law to retain certain personal data, for example for the purpose of proper accounting, to ensure compliance with tax regulations or to comply with advertising regulations, we process personal data as required by the applicable law.

Scope of data: shall not exceed the scope stipulated by law or necessary for the performance of the legal obligation in question.

Retention period: based on specific legislation.

Legal basis: performance of a legal obligation.

Legitimate interest to protect the rights of the Controller

Objective: The Controller shall retain, to a limited extent, the consent given, the legal acts performed by the subjects and any other necessary documentation for the protection of its rights, i.e. the enforcement of its rights (including claims), defence against claims by the subjects or third parties, and defence in inspection proceedings by the supervisory authority.

Scope of data: only documents necessary to prove compliance, exercise rights or defend against claims.

Retention period: three years from the end of processing under the original legal title, whereby the processing period shall not expire before any active legal or other proceedings.

Legal basis: legitimate interest.

Rights of the subject

Right of access to personal data - the data subject has the right to obtain confirmation from the Controller as to whether or not their personal data are being processed and, if so, the right to obtain access to such personal data and information pursuant to Article 15 of the GDPR.

Right to rectification - you have the right to have inaccurate personal data corrected or missing personal data completed by the Controller without undue delay.

Right to erasure - you have the right to have the Controller erase personal data concerning you without undue delay.

Right to restriction of processing - you have the right to have the Controller restrict the processing of your personal data.

Right to data portability - you have the right to obtain the personal data concerning, which you provided to the Controller and which are processed by automated means on the basis of your consent, in a structured, commonly used and machine-readable format, and you have the right to transmit these data to another controller. You have the right to have your personal data transferred directly to the other controller, if technically feasible.

Right to object - you have the right to object at any time to the processing of personal data concerning you. The Controller shall no longer process the personal data unless it demonstrates compelling legitimate grounds for processing, which override your interests or rights and freedoms, or for the establishment, exercise or defence of legal claims. If personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such purposes, which includes profiling. If you object to such processing, your personal data will no longer be processed for these purposes.

Other rights - the provision of data is voluntary. Consent to personal data processing may be withdrawn at any time free of charge. You have the right not to be subject to any decision based solely on automated processing, including profiling, which has legal effects on you or significantly affects you in a similar way.

The rights can be exercised by contacting the Controller. We will process all your requests without undue delay, in justified cases within 30 days at the latest, and any withdrawal of consent to receive commercial communications by electronic means will be processed without delay.

If you are in doubt about whether your rights are being respected, you can contact the Controller for redress or clarification.

You have the right to complain to the supervisory authority. The supervisory authority is the Office for Personal Data Protection, registered office at Pplk. Sochora 27, 170 00 Prague 7 http://www.uoou.cz.
